Is Obama's threat to issue executive orders if the GOP blocks his plans in Congress unconstitutional?

Isn't the use of this power by the president an effort of Obama "legislative" from the Executive Office. Isn't Congress supposed to be the ones making the laws and Obama the one carrying them out?
